The same special prosecutor in the Baldwin case, Kari T. Morrissey, submitted court filings in April stating that Gutierrez-Reed, who was found guilty of involuntary manslaughter in March, had berated Baldwin, 66, in taped prison calls, stating that she wanted to see him “in jail.”

The papers, which detailed the prosecution’s opposition to Gutierrez-Reed’s plea for a conditional discharge (probation instead of a jail term), only included summaries of the conversations with family members and other parties rather than transcripts of those conversations.

They cited Gutierrez-Reed’s jail calls to bolster their claim that she showed a “total failure to accept responsibility” after she unintentionally loaded live ammunition into the prop gun Baldwin was holding on set in 2021, killing cinematographer Halyna Hutchins and wounding director Joel Souza.

According to reports, Gutierrez-Reed branded prosecutor Morrissey a “bitch,” referred to the jury as “a——-,” and expressed her anger that the entire situation was placed on her in a number of different chats.

A call transcript stated, “Hannah wants them to put Alec Baldwin in jail also.”

“Hannah says she won’t show up if she is subpoenaed to Baldwin’s trial,” someone else said over the phone.

Jason Bowles, an attorney for Gutierrez-Reed, tells PEOPLE that when asked about the content of the calls made public by the records, “it’s really unfair to characterize or cherry pick comments someone may or may not have made while they were upset and very recently incarcerated.” However, a number of parts of this prosecution have shown a disregard for justice in favor of a “win at any costs” mentality.”

Prosecutors warned the court that Gutierrez-Reed “will likely attempt to have her previous statements admitted… if use immunity is not granted.” This was first reported by PEOPLE.In order to do this, the defendant must show that Ms. Gutierrez is not available because she has invoked her Fifth Amendment rights.

In the event that Gutierrez-Reed declines to testify, Baldwin’s lawyers may play snippets of her previous police interviews. According to Baker, “she’s very clear in her interviews that she should have checked [the gun] better.” Baldwin benefits from “those kinds of statements where she’s accepting responsibility.”

According to Baker, this made Gutierrez-Reed an astute legal film star to include on his witness list: “She would be able to plead the Fifth, is then unavailable and then he can use some of the clips.”

Morrissey claimed in court documents dated May that following the shooting, Baldwin made a suggestion to Gutierrez-Reed and her attorney.

“Mr. Baldwin basically promised to make a public statement on what transpired before Ms. Hutchins was killed.declaring that he (Mr. Baldwin) had no problems with Ms. Gutierrez and that he did not believe she had done anything illegal. In return, Mr. Baldwin requested that Ms. Gutierrez and her group refrain from publicly criticizing him in the media about
